Chief Examination by Sri. RAC for Sri. BNC the learned counsel for R2: -

I have been working as ARTO in Gokak since 01. 06. 2023. In response to the court summons, I have produced the following documents aND they are exhibited as; | Ex. R3 | | The certified copy of driving license extract of | | | | | | | |-------|---------------------------------------|--------------------------------------------------|--|--|--|--|--|--| | | Sri. Mallikarjun T. Parit S/o. Tukaram | | | | | | | | The vehicle with gross weight of 16, 200 kg falls under the category of heavy goods vehicle. As on 02. 08. 2017, as per Ex. R3, the holder was entitled to drive heavy goods vehicle. (Since, it is the defence that the insured vehicle driver was not authorized to driver heavy goods vehicle as on the date of accident i. e. , 02. 08. 2017, the counsel is permitted to cross examine the witness).

Cross Examination by Sri. RAC for Sri. BNC the learned counsel for R2: -

It is not correct to suggest that before amendment in 2018, the driving license was required to the issued mentioning the authorization to drive the class of vehicle such as light goods vehicle, medium goods vehicle aND heavy goods vehicle. It is not correct to suggest that though there was such mandate under the MV Act aND the Rules made there under, I am giving false evidence. It is not correct to suggest that as per Ex. R3, the holder of driving license was authorized to drive the heavy goods vehicle.

Chief Examination by Sri. DDP the learned counsel for Petitioners aND Sri. RSh. the learned counsel for R1: -
