Parties have appeared before the court in compliance of the notices directed to be issued on the LDOH.
It may be reiterated that vide order dated 02.03.2020 passed by the Ld. Predecessor of this court, all the ingredients u/s 14(1)(a) of DRC Act were held to be satisfied by the petitioner and in terms of Section 15(1) of DRC Act, the respondents were directed to pay or deposit the rent @ Rs.125/- per month w.e.f. 12.07.2010 till date alongwith simple interest @ 15% and to keep paying the same in future at the same rate on the 15 th day of every month. Apparently, the respondents have not complied with the said directions and benefit u/s 14(2) is to be decided in the present matter.
Accordingly, last and final opportunity is granted to the respondent side to comply with the directions as mentioned above, failing which no further opportunity shall be granted and appropriate order shall be passed in the matter.
Further, report be called from the Nazir regarding filing of any appeal in the present matter as well as stay, if any, on the NDOH.
Petitioner is also directed to remain present before the court alongwith counsel on the NDOH.
Now, put up for consideration on the aspect of benefit u/s 14(2) DRC Act on the NDOH i.e. 01.10.2022.
