One of the Personal Assistants has been withdrawn from this court and no other Personal Assistant is available at this stage.

Proceedings

Present: None for the petitioner.

Perusal of record shows that vide order dated 02.03.2020 vide separate judgment, it was held by the Ld. Predecessor of this court that all the ingredients of Sec. 14(1)(a) D.R.C. Act in respect of the tenanted premises as mentioned in the order were satisfied by the petitioner.

Order in terms of Sec. 15(1) D.R.C. Act was passed against the respondent and misc. file was directed to be prepared for ascertaining the benefit U/sec. 14(2) of the D.R.C. Act.

As per report of Nazir, the respondent has not deposited the rent in terms of Sec. 15(1) D.R.C. Act directed to be deposited vide order dated 02.03.2020 till date and vide previous order sheet dated 29.09.2021, notice was directed to be issued to the petitioner for appearance and pursuing the present petition.

In view of the same, issue fresh notice to the petitioner as well as respondent for appearance and pursue the present case on the NDOH i.e. 04.08.2022.
