Ld. Counsel for the petitioner.

Ld. Counsel for the respondent along with respondent.

Parties have apprised the Court that the appeal filed by the respondent against the impugned judgment dated 02.03.2020 before Ld. Principal District & Sessions Judge, West District, Delhi is still pending for disposal for 11.09.2023.

However, till date no stay order or directions for deposit of rent have been passed by the Ld. Appellate Court as informed to this Court by the counsels for the parties.

Ld. Counsel for the respondent has apprised the Court that he has already moved a stay application before the Ld. Appellate Court and he will also press for passing necessary directions by the Ld. Appellate Court regarding payment of rent in the present matter on the NDOH.

Said request is allowed. However, it is made clear that if no stay order or directions for payment of rent are passed by the Ld. Appellate Court in the present matter, no further opportunity shall be granted to the respondent and appropriate order shall be passed in the present case by this Court as per law qua the benefit U/Sec. 14(2) D.R.C. Act in the present case.

Further, report be called from Nazir of this Court regarding compliance of order dated 02.03.2020 by the respondent on the NDOH.

Now, be awaited for the orders to be passed by the Ld. Appellate Court / further proceedings on the NDOH i.e. 30.10.2023.
