Ld. Counsel for petitioner request for an adjournment as the evidence by way of affidavit of the concerned witness could not be prepared due  to some personal difficulty.

The  request made on behalf of the petitioner is not opposed by Ld. Counsel for R­3/Insurance company.

At this stage, an  application for issuing necessary directions  to the MS/CMO DDU Hospital, New Delhi for  issuance  of disability certificate has been moved on  behalf of  the petitioner.

Heard. File perused.

Ld. Counsel    for   the   petitioner submits that petitioner/injured has sustained grievous injuries and Disability Certificate will be required for   proper  adjudication  of  the   instant matter and   he prays that appropriate directions in this regard may be issued to the M.S., DDU Hospital.

In  view    of   the   above   and   in  the  interest of justice, Medical Superintendent of  DDU  Hospital be   directed to opine as to whether the injured had suffered the injuries in the accident and whether the said injuries are of permanent nature or not.

For   the  above­said    purpose,    petitioner/injured is required to be examined.  Accordingly,    petitioner   is   directed to appear before Medical Superintendent,  DDU  Hospital on 05.11.2019, who will constitute a medical board and will submit the report to this Court on or before NDOH.

Copy of     this   order   be sent   to the   MS  DDU  Hospital,  for information/ compliance.

Copy of this  order be also given 'Dasti' to the petitioner/ his counsel , as requested.

In view of above, put up for  above­said     report of M.S., DDU Hospital and PE on 16.3.2020, as requested.

Last and  final opportunity  is given to the petitioner.
