Sh. Bishnu Kant, counsel for petitioner.

None for R­1 Vivek @ Monu ( driver)  & R­2 Jai Bhagwan ( owner of offending vehicle).

Sh. Kamaldeep, counsel for R­3/Insurance company.

IO ASI Krishan is also present.

IO submits that  R­1 Vivek @ Monu  has already died  in some other accident.

Ld. Counsel for  petitioner submits that  he will take appropriate steps for bringing on record   the LRs of   deceased   R­1 ( driver of the offending vehicle)

Heard on the point of framing of issues.  File perused.

From the pleadings of the parties, following issues are framed:

ISSUES

    1. Whether  Baby Risha  sustained   grievous injuries in a motor vehicle accident dt. 20.5.2018 due to rash and negligent driving of vehicle   no. DL­7CD­7308 being driven   by respondent no. 1 Vivek @ Monu  , owned by respondent no.   2   Jai   Bhagwan       and insured by respondent  no.3   HDFC   Ergo   General Insurance    Co. Ltd. ? ...OPP
    1. Whether the petitioner is entitled to claim compensation if so , what amount and from whom? ... OPP

3. Relief .

No other issue has arisen or pressed.

List of witnesses be filed by the parties within 10 days. Advance copy of evidence be supplied to opposite parties at least two weeks before the NDOH.

In view   of   above   and   in   the  interest of justice, put up for PE on 14.10.2019, as requested.

In the meantime,  in compliance of the directions  issued vide order dated 15.12.2017 passed   by   the   Hon'ble   High Court of Delhi in MAC APP No. 422/2009 (    Sobat   Singh   Vs.  Ramesh Chandra Gupta) and FAO No. 842/2003 (  Rajesh Tyagi  &  Ors. Vs. Jaiveer Singh & Ors.), petitioner is directed  to  open  a savings bank account in  a  nationalized   bank   near   the  place  of  his  residence and the concerned bank is directed  not to issue any cheque book and/or debit card to   the petitioner and if the same have already been issued, the bank is directed to  cancel  the   same  and  make  an endorsement  on the passbook of the  petitioner  to the effect that  no cheque book  and/ or debit card shall be issued  without the permission of the  Court. Petitioner is further directed to produce the copy of this order before the concerned   bank    whereupon  the    bank   is   directed  to make the endorsement on the passbook.

Petitioner is also directed to produce the above­said passbook with the necessary endorsement as well as Aadhar Card and PAN Card  before this court  on the next date of  hearing.

Issue notice to R­2 through IO for the next date of hearing.

IO be also  summoned again for the said date.

Copy  of this  order  be  given  ' Dasti '  to the petitioner /  her counsel for information/compliance.

In view of above and in the interest of justice, put up for PE on

14.10.2019, as requested.

In the meantime, in compliance of the directions issued vide order
