    1. 2019 Present: AR for Complainant with counsel. Pre-summoning evidence by way of affidavit has been tendered. Vide separate statement of AR for Complainant, pre summoning evidence is closed. Arguments have been heard upon the point of summoning of the Accused. After going through the complaint, documents attached with it aND testimony of the Complainant, it prima facie appears that offence U/s 138 of N. I Act is committed aND it further appears that all the statutory requirements have been complied with aND delay in filing of complaint already condoned. Accused no. 1 is Company aND Accused no. 2 is Managing Directors of Accused no. 1 aND Accused no. 5 is signatory of the cheque in question. Sufficient grouND for summoning Accused 1, 2 aND 5 is made out. However, no sufficient grouND for summoning of Accused no. 3 aND 4 is made out. Let the Accused nos. 1, 2 aND 5 be summoned on filing of P. F. , aND R. C. /Speed post/Approved Courier with directions to the process server to serve the Accused person through affixation in case of non availability, refusal or if the premise was fouND locked, returnable for 04. 06. 2019. Steps be taken within two weeks. Ahlmad to issue summons within 10 days from filing of P. F. . Complainant is directed to utilize all the modes for the service of summons. Accused be served through affixation also in terms of Section 65 of Cr. P. C. Complainant is also at liberty to accompany the process server for effective service of summons.
