BWs issued against the Accused received back unexecuted with the report that Accused was not fouND at the address given aND he was contacted through mobile phone aND was apprised of the court proceedings as well as date of hearing. Further, his relative met at the given address who informed that Accused had not come for last three months. However, provided the mobile number of the Accused. The Pradhan of village was also contacted who also informed the same about Accused. Further, as per the report Accused refused to provide his current address despite knowing the court proceedings aND DOH while he was contacted through mobile phone. Since it is a digital court aND Accused is supposed to join the hearing through VC aND need not to come physically before the court. Further, I am of the opinion that Accused is well aware of the proceedings aND date of hearing aND despite that Accused has not preferred to appear before the court through VC which indicates that he is deliberately avoiding the process of the court. Let NBWs be issued against the Accused upon filing P. F. by the Complainant within ten working days aND NBWs be executed by the SHO concerned. Concerned SHO is further directed to make sincere efforts in the execution of warrants. Matter be put up before this court on 25. 01. 2022. (NIDHI BALA) MM/N. I.
