APPLICATIONS DATED 09.01.2023 ON BEHALF OF THE APPLICANT/ACCUSED SH. RAJEEV JAIN FOR SEEKING PERMISSION TO TRAVEL TO MALDIVES FROM 26.01.2023 TO 30.01.2023.

Through these applications, the applicant/accused Sh. Rajeev Jain has sought permission to visit Maldives from 26.01.2023 to 30.01.2023.

Copies of tickets of his departure to Maldives and arrival in Delhi are enclosed with these applications.

The accused has mentioned in these applications the address where he would be staying during the period of his aforesaid visit.

The accused has undertaken that he will neither dispute his identity nor question the legitimacy of any proceeding conducted in his absence and he will not or even attempt to tamper with the evidence and has also undertaken not to influence any witness of the prosecution to obstruct the proceedings.

It is further mentioned in the applications that the accused shall be available on 20.01.2023 and 23.01.2023 i.e. the dates fixed for PE.

The applicant/accused has also undertaken to comply with all the terms and conditions as may be imposed by this Court, for the purpose of traveling abroad.

Ld. DLA for CBI Sh. A.P. Singh and Ld. Special PP Sh. Rajesh Batra for ED have not filed replies to these applications. They have formally objected to the applications submitting that the present applications be disposed of taking into account the present facts and circumstances of the cases and also subject to the condition that the proceedings should not be hampered.

This Court has considered the submissions of Ld. Counsel for the applicant/accused Sh. Rajeev Jain and Ld. DLA for CBI Sh. A.P. Singh and Ld. Special PP for ED Sh. Rajesh Batra.

Vide order dated 31.05.2019, the accused was given permission to visit abroad earlier also but he never abused such permission and followed all the terms and conditions imposed by the court while granting such permission.

Considering the entirety of facts and circumstances, the applicant/accused Sh. Rajeev Jain is permitted to travel abroad to Maldives from 26.01.2023 to 30.01.2023, subject to following conditions:-

    1. He shall furnish FDRs for a sum of Rupees Twenty Lakh Only (Rs.20,00,000/-) in each case.
    1. He shall inform to the IO and the Court about his arrival in India mentioning the details of the places visited by him alongwith the other details of the itinerary within seven days of his arrival. The applicant/accused shall also file complete copy of his passport alongwith the copy of Visa in the Court on his return.
    1. He shall not tamper with the evidence nor try to influence any witness in any manner and will not use the permission granted to him so as to hamper the trial in any manner.
    1. This permission shall be subject to other applicable rules and will not be deemed as directions to any authority except the permission from the side of the Court.
    1. His Advocate Sh. Somesh Arora shall undertake to accept notice from the Court/IO, if any, on behalf of the applicant in his absence and shall further undertake that in case the presence of applicant is required during the aforesaid period he shall immediately intimate the applicant and the applicant shall return to India within 48 hours.

Applications are accordingly disposed off.

As prayed, a copy of this order be given dasti to Ld. Counsel for applicant/accused.
