Copies have already been supplied to CBI as well as ED on 12.12.2022.
It is mentioned in these applications that vide order dated 08.12.2022 passed by this court, the itinerary filed by the applicant/accused Sh. Naveen Jindal for traveling to Oman, UAE and Algeria from 15.12.2022 to 20.12.2022 was taken on record.
It is further mentioned in the application that, now the applicant/accused is required to travel to Mozambique and Guinea in addition to the aforesaid countries during the period as stated in the said travel itinerary. Along with these applications, the applicant/accused Sh. Naveen Jindal has also filed copies of the invitations (Annexure A-1) dated 12.12.2022 to travel to Mozambique and Guinea.
In paragraph 3 of these applications, the applicant/accused Sh. Naveen Jindal has undertaken that he will neither dispute his identity nor question the legitimacy of any proceedings done including recording prosecution evidence in his absence.
It is also mentioned in these applications that there is no apprehension that the applicant will tamper with evidence and further he will not influence any witness of the prosecution or tamper with any kind of evidence.
Sh. A.P. Singh, Ld. DLA for CBI has formally objected to the said application submitting that the dates of visits to all the countries have been bunched together without mentioning the date of visit to each country specifically. The Ld. Counsel for the accused has submitted that Algeria,
Mozambique and Guinea are connected by road and shall be visited by the accused accordingly as per the business requirements.
Sh. Rajesh Batra, Ld. SPP for ED submitted that the present applications be disposed of taking into account the present facts and circumstances of the case and also subject to the condition that the proceedings should not be hampered.
This Court has considered the submissions made in the applications. This Court has also considered the submissions of Ld. Counsel for the applicant/accused, Ld. DLA for CBI Sh. A.P. Singh and Ld. Special PP for ED Sh. Rajesh Batra.
As prayed, the itinerary furnished by the applicant/accused Sh. Naveen Jindal for his travel to Mozambique and Guinea in addition to Oman, UAE and Algeria from 15.12.2022 to 20.12.2022 is taken on record.
