APPLICATIONS DATED 17.05.2022 ON BEHALF OF APPLICANT/ ACCUSED RAJEEV JAIN SEEKING PERMISSION/ NO OBJECTION FOR RENEWAL OF HIS PASSPORT FOR ITS FULL TERM OF 10 YEARS.

It is submitted through the present applications that applicant/accused Rajeev Jain is holding passport no. K8851487 dated 23.11.2012 with validity till 22.11.2022 and in case of pendency of any criminal case like the present one the passport authorities do not renew the passport until and unless permission/no-objection is granted by the Court for a period beyond one year.

It is submitted by Ld. Counsel for applicant/accused Rajeev Jain that the applicant/accused has already applied for renewal of his passport before

Passport Authority without obtaining permission/no-objection from this Court. He has submitted that it was a bonafide mistake which occurred due to wrong advice given by the person who was asked for getting the passport of the applicant/accused renewed. The applicant/accused has tendered sincere apology for applying renewal of his passport without permission/no-objection of this Court. He has submitted that it was a bonafide mistake which shall not happen again and has undertaken to be cautious in the future.

It is further mentioned in the applications that applicant/accused can travel abroad only with the prior permission of this Court and that as per clause (a) (i) of the Notification dated 25.08.1993 issued u/s 22(a) of the Passport Act, 1967, the passport can be renewed for a period of 10 years, if this Court grants permission/no-objection for renewal of passport for its full term of 10 years.

Ld. ALA Sh. V.K. Sharma and Ld. Counsel Sh. Rajesh Batra submitted that they do not wish to file any written reply to the aforesaid applications and submitted that same be disposed off considering the present facts and circumstances of the case.

Considered. Perused.

Considering the fact that applicant/accused shall travel abroad only with the prior permission of this court, accordingly this Court has no objection, if the passport of applicant/accused Sh. Rajeev Jain is renewed by Passport Authority/Regional Passport Officer, for a period of 10 (ten) years. Applicant/accused Rajeev Jain is directed that as and when his passport is renewed, he will place on record a copy of his renewed passport and will supply a copy to the IO also.

Applications are disposed off accordingly.
