IA/51/2024: APPLICATION DATED 19.11.2024 ON BEHALF OF APPLICANT/ACCUSED SH. SIDDHARTH MADRA A-13 SEEKING PERMISSION TO TRAVEL ABROAD TO KENYA FROM 27.11.2024 TO 17.12.2024.
It is mentioned in this application that applicant/accused was released on regular bail on 15.10.2018 with the condition that he will not leave the country without permission of this Court.
It is further submitted in the application that Smt. Divya Datt, wife of applicant/accused, is working as a Senior Programme Management Officer in the United Nation Environment Programme/Regional Office for Africa, Nairobi and has been residing at 1203, Tower A, Oakland Apartments, Peponi Road, Nairobi, Kenya from 01.08.2024 and applicant/accused is desirous of visiting his wife during the said period i.e. from 27.11.2024 to 17.12.2024 in order to keep the bonds of marriage healthy and flourishing.
It is further submitted that applicant/accused will be residing with

his wife during the period of his visit i.e. at 1203, Tower A, Oakland Apartments, Peponi Road, Nairobi, Kenya. It is also submitted that applicant/accused during the course of his travel may visit other parts of Kenya along with his wife and he undertakes to file his itinerary detailing the list of places he has visited during the course of his travel upon his arrival back in India.
On earlier occasions also, the applicant/accused was granted permission by this Court to travel abroad and applicant had abided by all the conditions imposed by this Court.
It is further mentioned in the application that no part of the present offence is stated to have been committed in Nairobi, Kenya and applicant/accused is willing and ready to abide by any condition that may be imposed upon him by this Court and he shall not flee from justice nor thwart the process of law.
It is further mentioned in the application that no prejudice shall be caused to the ED in case the applicant/accused may be allowed to travel abroad and he has always cooperated with the investigation agency as and when he was called upon to do so. It is further submitted that applicant/accused is seeking permission to travel abroad only for the purpose of fulfillment of his personal obligations and the applicant/accused shall suffer irreparable loss and grave prejudice in case said application is not allowed.
The applicant/accused has also undertaken that in his absence, he shall be duly represented by his appointed Counsel.
Accordingly, permission is sought to travel to Kenya from 27.11.2024 to 17.12.2024.
Ld. Special PP for DoE has not filed any reply but has opposed the application formally.
Considering the entirety of the facts and circumstances of this application, this Court deems it appropriate to permit the applicant/accused to travel abroad to Nairobi, Kenya from 27.11.2024 to 17.12.2024, subject to following conditions:-
