APPLICATION IN COMPLIANCE OF COURT'S ORDERS DATED 18.01.2023 AND 11.04.2023 ABOUT RETURN OF MR. NAVEEN JINDAL TO INDIA.

Vide order dated 11.04.2023, applicant/accused Naveen Jindal was granted permission to travel to UK, VIENNA, HUNGARY, ROMANIA AND SPAIN FROM 16.04.2023 TO 23.04.2023. However, in the compliance filed today i.e. on 26.04.2023, it is mentioned in the application that due to certain urgent meetings, the applicant had to travel to Czech Republic from 20.04.2023 to 21.04.2023 and came back into India on 22.04.2023.

Ld. DLA for CBI Sh. A.P. Singh and Ld. Special PP for ED Sh. Rajesh Batra submit that this travel of applicant/accused Naveen Jindal is not in terms of the permission granted vide order dated 11.04.2023 and his further right to travel abroad be taken away. They submitted that even on 20.04.2023 neither this Court nor CBI nor ED were informed about the visit of applicant/accused Naveen Jindal to Czech Republic.

Ld. DLA for CBI and Ld. Special PP for ED seek some time to file reply to aforesaid applications of applicant/accused Naveen Jindal.

Sh. Gurpreet Singh Parwanda, Ld. Counsel for applicant/accused submits that meeting of applicant/accused at Czech Republic was an urgent and therefore, he could not intimate the Court or IO.

Considered.

Perusal of records shows that in Case No. CBI/248/2019 titled CBI vs. M/s Jindal Steel and Power Ltd. & Ors. Applicant/accused Naveen Jindal was granted bail on 22.05.2015; in Case No. CBI/314/2019 titled CBI vs. M/s Jindal Steel and Power Ltd. (JSPL) & Ors. Applicant/accused Naveen Jindal was granted bail on 04.09.2017 and in Cr. Case No. 01/2019

titled ED vs. M/s Jindal Steel and Power Ltd. & Ors. Applicant/accused was granted bail on 15.10.2018. It was a condition of the aforesaid bail orders that applicant/accused Naveen Jindal shall not leave India without prior permission of this Court.

However, in Case No. CBI/248/2019 titled CBI vs. M/s Jindal Steel and Power Ltd. & Ors. on 12.08.2015, on the request of Ld. Defence Counsel for applicant/accused, the condition imposed upon the accused vide order dated 22.05.2015 directing him to not leave the country without prior permission of this Court was modified and it was directed that henceforth before leaving the Country in connection with his business interests, accused shall intimate the Court not later than three days before the actual date of journey about his travel plan, itinerary and his contact addressed during the said travel and said order dated 12.08.2015 remained in force till the stage of Charge.

Further on 13.03.2019 in the aforesaid cases, upon the application of applicant/accused Naveen Jindal dated 11.03.2019, it was accordingly directed that henceforth before leaving the Country in connection with his business interests accused shall intimate the Court not later than three days before the actual date of journey about his travel plan, itinerary and his contact addressed during the said travel.

Perusal of records shows that on 12.10.2020, it was directed that the earlier order dated 13.03.2019 passed by this Court, whereby applicant/accused Naveen Jindal was granted liberty to travel abroad after giving intimation, shall remain in abeyance till further orders.

Further it is apparent from the records that on 14.07.2022 in the aforesaid cases, it was directed that order dated 13.03.2019 directing

accused before leaving the country shall intimate the Court not later than three days before the actual date of journey about his travel plan, itinerary and his contact addressed during the said travel was initially revived for a period of six months and that applicant/accused shall also comply with other terms and conditions of order dated 13.03.2019 before travelling abroad every time.

Also, on 18.01.2023 in the above cases, it was directed that orders dated 13.03.2019 and 14.07.2022 directing that before leaving the country the accused shall intimate the Court not later than three days before the actual date of journey about his travel plan, itinerary and his contact addressed during the said travel are further extended for a period of six months.

Considering the over all facts and circumstances of the case and the submissions made, now it is directed that till disposal of applications dated 26.04.2023, the applicant/accused Naveen Jindal shall not travel abroad without permission from this Court.

Aforesaid applications be put up now on 17.05.2023 for consideration and filing of reply by CBI and ED.

Vide order dated 11.04.2023, applicant/accused Naveen Jindal

was granted permission to travel to UK, VIENNA, HUNGARY,

was granted bail on 15.10.2018. It was a condition of the aforesaid bail

orders that applicant/accused Naveen Jindal shall not leave India without
