This is the suit filed by the plaintiffs prays to pass a preliminary decree for a sum of Rs.12,32,298/- with subsequent interest thereon as per contract rate of interest from the date of suit till the date of repayment and for costs of the suit creating a security for due realization of the entire suit amount with costs and subsequent interest by bringing the hypothecated property b) and in case of default to pay the amount to pass a usual final decree in terms of the preliminary decree scene of observation report as to bring the hypothicated property to sale for due realization of the entire amount due under the decree.c) in case of sale proceeds are found in sufficient to satisfy the decree the liberty be given to the plaintiff to apply for a personal decree against the defendants to recovery of balance amount as may be found due. award costs of the suit
This suit is coming before me today for hearing on 20.10.2022 in the presence of Sri d.B.Lok Advocate for the plaintiff and Sri V.Nageswsara RAo, Advocate for the defendant and having stood over the matter for consideration this court delivered the following
Plaintiff called absent, No representation. Even Several opportunities given plaintiff failed to get ready. Inspite of imposing condition plaintiff failed to get ready. It seems plaintiff has no interest to proceed further. Hence suit is dismissed no costs.
