Special Case No. 01 of 2020

23 29.11.2024 Today is fixed for S/R and appearance.

Accused persons namely S.Sreenath, K.R. Lakshmanan and Sajan T. Oommen appeared after receipt of summons.

Accused persons file applications praying for bail.

Ld. PP and Ld. Advocates for the accused are present.

Bail applications filed by accused persons are taken up for hearing.

Ld. Advocate for the accused submitted before this court that the investigation of this case has been completed and charge sheet has been submitted and the accused persons appeared today after receipt of summons from this court and that accused persons have cooperated with the investigating agency during investigation and there is no adverse report. He prays for bail imposing any condition.

Ld. PP submitted that the chargesheet has already been submitted after completion of the investigation and left the matter in the discretion of the court.

Heard both sides.

Perused the case record and the materials available in the record.

On perusal of the record, it appears that investigation of this case has been culminated into charge-sheet and the accused persons appeared today after receipt of summons from this court and as such, no purpose would be served in languishing the accused persons in jail and custodial interrogation of the accused person is not required for the purpose of investigation.

Considering the same, the bail prayer of the accused

persons namely S.Sreenath, K.R. Lakshmanan and Sajan T. Oommen is considered and allowed.

Hence, it is,

ordered

that the accused persons namely S.Sreenath, K.R. Lakshmanan and Sajan T. Oommen may find bail of Rs.6,000/- each with two sureties of Rs.3000/- each subject to satisfaction of Ld. Chief Judicial Magistrate, Port Blair with direction to appear before the court on every effective date of trial and and not to hamper/tamper the evidence of this case.

Let a copy of this order be sent to the Ld. Chief Judicial Magistrate, Port Blair for information.

To 30.01.2025 for appearance of the accused persons and supply of copies.
